Term of Services
Eden Oasis Landscaping LLC — Terms of Service
Last Updated: September 30, 2026
These Terms of Service (“Terms”) apply to services provided by Eden Oasis Landscaping LLC (“Eden Oasis,” “we,” “our,” or “us”). By accepting an estimate, paying a deposit, scheduling work, or allowing work to begin, the customer agrees to these Terms.
1. Estimates and Scope of Work
All estimates are based on the information, measurements, photographs, site conditions, and requested scope available at the time the estimate is prepared.
Unless otherwise stated, estimates are not intended to cover unforeseen conditions or additional work discovered after the project begins.
Changes to the original scope may result in additional charges. Whenever reasonably possible, additional work and pricing will be discussed with the customer before proceeding.
2. Deposits and Scheduling
A deposit may be required to reserve a project date and secure materials.
Unless otherwise stated on the estimate or invoice, Eden Oasis may require a 50% deposit, with the remaining balance due upon completion.
Project dates are not guaranteed until any required deposit has been received.
Deposits used to purchase custom-ordered, perishable, delivered, or non-returnable materials may be non-refundable once those materials have been ordered.
3. Payments
Payment terms will be stated on the customer’s estimate or invoice.
Final payment is due upon completion unless other arrangements have been agreed to in writing.
Accepted payment methods may vary by project. Customers should confirm available payment methods before submitting a deposit.
Past-due balances may be subject to reasonable collection costs or other remedies permitted by applicable law.
4. Cancellations and Rescheduling
Customers should provide as much notice as possible when canceling or rescheduling work.
Eden Oasis reserves the right to reschedule work because of weather, unsafe conditions, material availability, equipment issues, supplier delays, or circumstances outside our reasonable control.
If materials have already been purchased specifically for the customer’s project, the customer may be responsible for those material costs.
5. Property Access
The customer is responsible for providing reasonable access to all areas where work is scheduled.
Vehicles, furniture, toys, pet waste, personal belongings, and other obstacles should be removed when reasonably possible before work begins.
Customers must notify Eden Oasis of known underground or concealed conditions, including:
- Irrigation or sprinkler systems
- Invisible dog fences
- Private electrical lines
- Drainage systems
- Landscape lighting
- Septic components
- Private utility lines
- Other buried improvements
Eden Oasis is not responsible for damage to unmarked, undisclosed, improperly installed, or concealed private utilities or systems to the extent permitted by law.
6. Sod and Lawn Installation
Sod installation estimates are generally based on estimated square footage and visible site conditions.
Final quantities may change if actual measurements or site conditions differ from the original estimate.
Standard sod preparation may include removal of existing vegetation, soil preparation, minor grading, starter fertilizer, installation, rolling, and initial watering when specified in the estimate.
Unless specifically included, extensive grading, drainage correction, irrigation installation or repair, major soil replacement, and additional topsoil are considered separate services.
7. Sod Watering and Aftercare
Once installation is completed, the customer is responsible for proper watering and ongoing care unless a maintenance agreement states otherwise.
New sod requires consistent moisture during establishment. Weather conditions, irrigation coverage, soil conditions, pets, foot traffic, insects, disease, drought, excessive rainfall, and improper watering can affect establishment.
Eden Oasis cannot guarantee sod survival when recommended watering and care instructions are not followed or when conditions outside our control affect the lawn.
8. Concrete and Hardscape Work
Concrete and hardscape estimates are based on the dimensions, thickness, preparation requirements, access, and site conditions described in the estimate.
Concrete is a natural cement-based product. Minor variations in color, texture, appearance, and finish can occur.
Hairline shrinkage cracks may occur as concrete cures and are not necessarily evidence of defective workmanship.
Customers should follow all curing and use instructions provided after installation.
Work not specifically included—such as removal of existing structures, unexpected excavation, unsuitable subgrade correction, drainage work, or concealed obstacles—may result in additional charges.
9. Existing Conditions
Eden Oasis is not responsible for pre-existing property conditions or defects that become visible during or after work, including poor drainage, unsuitable soil, erosion, buried debris, unstable subgrade, disease, pests, or improperly installed previous work.
If unexpected conditions substantially change the amount of labor or materials required, Eden Oasis will discuss available options with the customer.
10. Weather and Natural Conditions
Landscaping and exterior construction are weather-dependent.
Rain, excessive heat, freezing conditions, storms, saturated soil, drought, and other conditions may require work to be postponed.
Reasonable weather delays do not constitute abandonment or breach of the project agreement.
11. Materials
Natural materials—including sod, soil, stone, mulch, wood, plants, and concrete—can vary in appearance, texture, moisture, density, shade, or coloration.
Reasonable natural variations are not considered defects.
12. Customer-Supplied or Customer-Performed Work
When a customer agrees to complete a portion of the work before Eden Oasis begins—for example, removing brick, furniture, vegetation, structures, or other materials—the area must be sufficiently prepared before the scheduled start date.
Delays or additional work caused by incomplete customer preparation may require rescheduling or additional charges.
13. Photos and Project Documentation
Eden Oasis may photograph or video project areas before, during, and after work for documentation, quality control, portfolio, website, or marketing purposes.
We will make reasonable efforts not to display personally identifying information such as house numbers, license plates, or individuals without permission.
Customers may request in writing that their property not be used for promotional purposes.
14. Warranty and Limitations
Any specific workmanship warranty offered by Eden Oasis will be identified in the customer’s written estimate, contract, or invoice.
Unless expressly stated otherwise, Eden Oasis does not guarantee living materials such as sod, seed, plants, or trees against damage resulting from weather, improper watering, pests, disease, animals, neglect, or other conditions outside our reasonable control.
Nothing in these Terms excludes rights or remedies that cannot legally be waived.
15. Damage and Concerns
Customers should notify Eden Oasis promptly if they believe there is a problem with completed work.
We should be given a reasonable opportunity to inspect and, where appropriate, address workmanship concerns before another contractor alters or repairs the disputed work.
16. Changes to the Project
Requests for additional work may require a written or verbal change authorization and additional payment.
Examples include additional square footage, additional sod or soil, grading, drainage corrections, irrigation work, additional concrete, excavation, hauling, or removal of materials not included in the original scope.
17. Entire Agreement
The customer’s estimate, invoice, written change orders, and these Terms together form the agreement between Eden Oasis Landscaping LLC and the customer regarding the project.
Where the customer’s specific written estimate conflicts with these general Terms, the project-specific written terms will control.
